Terms of Service
These are the rules for playing our games. They are written to be read, not skimmed past: most of them exist to keep the game fair for everyone on the leaderboard, and the rest say plainly what you get and what we cannot promise. By installing or playing a ViewPoint Studio game you agree to them. If you do not agree, please do not play. Our Privacy Policy explains what happens to your data and is part of these terms.
I. Who we are and what these terms cover
ViewPoint Studio is an independent game studio based in Israel ("we", "us"). These terms cover our games (today: DeathCube on Android), the online services behind them (accounts, leaderboards, progress saved on our servers), and this website (together, the "Services"). Where a game needs something specific, section IX says so.
Our games are distributed through app stores such as Google Play. The store's own terms also apply to your download and to any purchase you make through it; where the store's terms and ours conflict about a purchase, the store's terms win for that purchase.
II. Who may play
Our games are not directed at children under 13 (or under the age of digital consent where you live, up to 16 in parts of the EU). If you are under 18, play with the permission of a parent or guardian, who accepts these terms on your behalf. We may remove an account if we learn it belongs to a child below the minimum age.
III. Your account
- It is created for you. When you first open a game, an anonymous account is created automatically so your progress can be saved. You can link it to a Google account to keep it if you lose or change your phone. An account that is never linked lives on that phone only.
- One person, one account. Do not create accounts to manipulate leaderboards, to evade a block, or to trade them. An account is yours to play with, not to sell, lend or transfer.
- Your name. The player name you choose is shown to other players on leaderboards. Names that are offensive, impersonate someone, or pretend to be staff will be removed; we may rename an account and let you pick again.
- Deleting it. You can delete your account from inside the game at any time, or by e-mail; deletion is final and cannot be undone. Details are on the account deletion page.
- Unused anonymous accounts that never played a run and have not opened the game for 180 days are deleted automatically, as described in the Privacy Policy.
IV. Fair play
Every score is a distance, and every distance is checked by our servers before it counts. Please play the game the way it is shipped:
- Do not modify the game, its data, or the messages it sends to our servers; do not use cheats, bots, macros, automation, emulator tricks, or any tool that submits runs you did not play.
- Do not exploit bugs to gain coins, records or leaderboard positions. If you find a bug that gives an advantage, tell us at support@viewpoint-studio.com instead of using it.
- Do not attack, probe or overload our servers, and do not try to access other players' accounts or data.
What happens if you break these rules. Runs that fail our checks are refused. Accounts that submit impossible runs can have their records, coins, upgrades and leaderboard entries removed, and after repeated offences can be blocked from submitting runs, buying items and choosing a name. We keep an anonymised record of such actions to keep the leaderboards honest, even after an account is deleted. We decide these cases from the evidence our servers hold; you can write to us if you believe a decision was wrong, and we will look again, but we cannot promise to reverse it.
V. Coins, upgrades and other virtual items
- Coins have no money value. Coins, upgrades, shapes, skins, titles and any other virtual item are a limited licence to use a feature inside the game, for as long as the game and your account exist. They are not property, cannot be exchanged for money or transferred between accounts, and we do not buy them back.
- Balance is ours to keep. We may change how many coins a run earns, what items cost, what an upgrade does, add or retire items, and reset progression in a pre-release test, in order to keep the game fair and fun. We will announce material changes inside the game. Items you paid real money for keep their function or an equivalent one.
- Everything can be earned by playing. Any item that affects gameplay can be earned with coins from play; real money, where offered, only buys convenience, cosmetics, or a shortcut to a capped item that everyone can reach.
VI. Purchases
Where a game offers real-money purchases, they are made through the app store (for DeathCube, Google Play) and charged by it, in its currency and under its terms. Prices shown in the game come from the store and may differ by country. A purchase delivers virtual items or a feature (for example removing advertising) to the account that made it, on the device where it was made; it cannot be moved to another account.
Refunds follow the store's refund policy; request them from the store. If the store refunds a purchase, the items it bought may be removed from the account. Deleting your account forfeits every purchase in it; we cannot restore purchases to a deleted account.
We do not sell anything on this website.
VII. Advertising
Where a game shows advertising, some ads are optional and rewarded (for example, watching an ad to continue a run) and some are shown between runs. An ad-free option, where offered, removes the ads shown between runs; rewarded ads you choose to watch stay available. Ads are served by third parties under the rules in our Privacy Policy, including your consent choices where the law requires them.
VIII. Leaderboards, titles and content
- Leaderboards and titles reflect what our servers accepted. We may remove entries that were obtained against these terms, correct errors, and reset boards for a new season or a pre-release test.
- The only thing you create in our games is your player name. Everything else in the game — code, art, sounds, names, characters, the DeathCube name and logo — belongs to ViewPoint Studio or its licensors. You get a personal, non-transferable licence to play; you may not copy, sell, modify, reverse-engineer or redistribute the game except where the law expressly allows it.
- You are welcome to record and share videos and screenshots of your play, including monetised videos, as long as you do not claim the game is yours.
IX. Game-specific terms
DeathCube
- Score is distance in a single run; a run counts only when it ends and our server accepts it. Runs played offline are sent when the phone reconnects and are checked like any other; the phone keeps a limited number of unsent runs and older ones are dropped.
- Head Start metres never count as distance run and never earn coins.
- A run that used a dev or test feature is never ranked.
- During pre-release testing we may reset accounts, coins, titles and boards without notice.
X. Availability and changes
We are a small studio. We will do our best to keep the Services running, but we cannot promise they will always be available, error-free, or unchanged. We may update, change or discontinue a game or a feature, including the online services behind it. If we ever shut a game down, we will give reasonable notice inside the game and on this site. Playing requires an internet connection for saving progress and leaderboards; the game works offline within the limits described above.
XI. What we do not promise
The Services are provided "as is". To the extent the law allows, we make no warranties about them, and we are not liable for indirect or consequential losses, lost data, lost virtual items, or lost leaderboard positions. Nothing in these terms limits liability that cannot be limited by law, including for death, personal injury, fraud, or your statutory consumer rights where you live. Where our liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or 50 USD, whichever is higher.
XII. Ending the agreement
You can stop at any time by deleting your account or uninstalling the game. We can end or suspend your access if you break these terms, if the law requires it, or if we discontinue the Service; where the reason is your conduct, we will tell you inside the game or by e-mail where we have one. Sections IV, V, VIII, XI and XIII survive the end of the agreement.
XIII. Law, disputes and changes to these terms
These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv have jurisdiction, without taking away any protection you have as a consumer under the mandatory law of the country where you live. Before going to court, write to us; most problems are solved by e-mail within a few days.
We may change these terms. Small changes take effect when posted here with a new date; material changes are announced inside the affected game (DeathCube: the in-game inbox) before they take effect. Continuing to play after that date means you accept the new terms.
